The claim is that they traced poses from an account that literally offers stock images to use as a reference.

Tbh, refs like that shouldn't be traced imho. Like, if you want to trace a model, use one of those free posing programs, don't just trace over some rando on the internet.

The randos in the stock photos have posted them online for this exact purpose. Also 3D model posing programs cost money and they kind of suck because they don't demonstrate realistic balance and weight very well. Also people have been drawing and painting over photo type references for hundreds of years:

If the photo isn't under creative commons then a tracing of it might be a problem, but that's not an issue here.

Not all 3D pose programs cost money,

Magic Poser is really good and completely free to use ( unless you want to pay for additional, more stylized models, but that's optional ) and so is Just Sketch Me and Pose My Art! I personally use MP and PMA whenever I do digital art and I am struggling with a pose.

They still suck because they're static, stiff, and unless you're really versed in making models yourself, they're usually lacking diversity.

I'd rather pay a few bucks to folks like https://www.deviantart.com/adorkastock (varied body types, including trans and disabled folks) or https://www.fatphotoref.com/ because they literally post these things so folks with varying body types can have more presence in the art world.

Ofc! I'm just giving examples of some free programs you can use on your browser. If you can find more resources for various body types, go for it!

While I do agree that selling traced content, at least for USD or other real life currencies, is distasteful nothing in the CC-BY-SA 3.0 license states tracing is prohibited for the image in question https://creativecommons.org/licenses/by/3.0/au/ link from pose accounts journal with their rules and terms of use.


But you already know this Dakkokki, you are a proffesional photographer per your toyhouse account afterall ;)

It's just my personal opinion. I ain't gonna stop anyone that wants to trace over them, but tracing for commissions is still a big no in my book and is a bit sus.

Also I do wildlife and still life photography, not reference photos for people to use freely.

Yeah people are trying to complain that the artist was referencing a pose from theposearchives:

These photos are posted under creative commons 3.0. They require attribution for photomanip but not for drawings.

I think people like shamirr also really misunderstand 'tracing' when it comes to photoref. There are no lines to trace here- when you draw on top of a photograph you have to make plenty of decisions about how to interpret the 3D forms of the photo in your sketch. The photo doesn't have lines to 'trace' in the way that another person's line art does. If the photo you're referencing is not posted under creative commons and the sketch is very similar to the original then you might get in trouble with copyright law- but that would be the case regardless of whether you started drawing directly on top of the photo you were referencing or not.
