It's another thing to hold them because someone is willfully active on BMT sites, has a history of multiaccounting, and is likely planning on making a new account.
People who are banned are allowed to make a new account. What isn't allowed is making a new account and immediately having funds, items and dragons from their previous account given to them- it's essentially ban evasion.
Happened to a friend of mine- both the person making the new account and the person doing the holding were both banned.
